How it works

Mayle Mediation is available for in-person and remote (Zoom) mediations. For in-person mediations, mediation will take place at the location of the parties’ choosing, most typically at the law office of one of the parties. If a law office is not available, Mayle Mediation is able to arrange for the use of an off-site neutral location, at cost to the parties and is also to arrange video conferencing if desired.

We do not charge administrative or case initiation fees.

Mediation services are billed at $195 per hour, including preparation time, telephone conferences and mediation sessions. Mayle Mediation will divide the bill equally among the parties unless other arrangements are requested. Payment is due within 14 days of the completion of the mediation session.

We will always respond to electronic materials submissions with confirmation that the materials have been received. Mediation services are billed at $195 per hour, including preparation time, telephone conferences and mediation sessions. Travel time outside of the Grand Junction area is billed at $100 per hour. Mayle Mediation does not charge administrative or case initiation fees.

Unless the attorneys provide written notification of other arrangements, Mayle Mediation will divide the bill equally among the parties. In cases where several parties with similar interests are represented by one counsel (e.g., a corporation and its board of directors or multiple plaintiffs), if preparation and mediation time are no greater than they would be for a single entity, we reserve the right to bill that group as one party, so long as it would be more equitable to do so.

Costs, such as securing an off-site mediation location or travel costs are also billed to the parties equally.

Payment is due within 14 days of the completion of the mediation session. Parties represented by an attorney are not required to pay a retainer or advanced payment. The attorneys agree that they are responsible for payment of the bill.

Pro se parties who are not represented by an attorney are required to pay a $750 retainer no later than seven days prior to the scheduled mediation.

Cancellation

Mediations canceled within 14 days of the scheduled date will be assessed a $1000 cancellation fee per scheduled mediation day, unless Mayle Mediation is able to fill the day with another matter. Should Mayle Mediation succeed in booking another case on the date canceled, no late cancellation fee will be assessed.

Responsibility for Payment

As Mayle Mediation has no control over the attorneys’ client selection process and retainer agreement, the attorneys of the parties are ultimately responsible for payment of the mediation fees and costs irrespective of the attorneys’ payment arrangement with their clients. The attorneys agree that payment will be made with 14 days of the completion of the mediation session.

Deposits

Deposits are required from all pro se parties.

For settlement conferences involving pro se parties, a deposit of $750 per day shall be required at the time the case is set.


Deposits are required in all cases involving travel costs outside of the Grand Junction Area

For matters outside of the Grand Junction Area requiring overnight stays, actual expenses (including airfare, hotel, meals, parking, car rental and ground transportation) will be billed. For those travel expenses, Mayle Mediation will require an advance cost deposit.


Mediation Materials

Mediation materials should be submitted in electronic form no later than five days prior to the scheduled mediation session. Mayle Mediation has found that it is in the best interests of the parties and the overall success of the mediation if mediation materials are focused only on key issues and information. Accordingly, Mayle Mediation requests that that the attorneys make a focused effort to limit the mediation materials submitted to no more than 200 pages (including the mediation statement and any attachments).

Arbitration

Mayle Mediation does not currently conduct arbitrations.
